By accessing or using the SV.GOAT application, website at svgoat.app, or GOAT device hardware (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by MDONZELLI LTD ("we", "us", "our"), a company registered in England and Wales. If you do not agree to these Terms, do not use the Service.
SV.GOAT is a boat monitoring platform that allows users to remotely monitor vessel systems through a dedicated hardware device (the "GOAT device") connected to the vessel's NMEA 2000 network and SignalK server. The Service includes real-time telemetry monitoring, anchor watch alerts, weather forecasts, voyage logging, vessel sharing, AI-assisted insights, and related features accessible via the Android app and web application.
To use the Service, you must create an account. You agree to:
The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually at the rates displayed at the time of purchase. We reserve the right to change pricing with 30 days' notice to existing subscribers.
The GOAT device is sold separately and is required for vessel monitoring. Device purchases are non-refundable after 30 days unless the device is defective.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
As a user of the Service, you agree to:
The Service allows you to share access to your vessel's data with other users. When you share access, you grant those users the ability to view your vessel's telemetry data, position, and status. You are responsible for managing who has access to your vessel's data and may revoke access at any time. We are not responsible for how shared users may use the data they view.
The GOAT device remains your property after purchase. However, the software running on the device is licensed, not sold, and is subject to these Terms. The device receives automatic over-the-air (OTA) software updates. By using the device, you consent to receiving these updates.
You are responsible for the physical installation of the GOAT device on your vessel. We are not liable for any damage caused by improper installation, electrical issues, or incompatibility with your vessel's systems.
All intellectual property rights in the Service, including the software, design, branding, and documentation, are owned by MDONZELLI LTD. Your use of the Service does not grant you any ownership rights. Your vessel data remains your property; we claim no ownership over your telemetry data, voyage logs, or other content you generate through the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Critical safety disclaimer: SV.GOAT is a supplementary monitoring tool. It is NOT a substitute for proper marine safety equipment, practices, watch-keeping, or professional seamanship. Do not rely on the Service as your sole means of monitoring vessel safety. Sensor data may be delayed, inaccurate, or unavailable due to network conditions, device malfunction, or other factors.
We do not guarantee uninterrupted, timely, secure, or error-free operation of the Service. Internet connectivity, cellular coverage, and power availability affect the GOAT device's ability to transmit data.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDONZELLI LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR VESSEL DAMAGE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability for any claim arising from the Service shall not exceed the amount you have paid to us in subscription fees in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless MDONZELLI LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.
You may terminate your account at any time by deleting it through the app settings or by contacting us. We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your data.
